2023 CCSA Spring Workshop Pre-Recorded Session: The Government Claims Act: Immunities and Claim Filing Protections (1.0 MCLE Hrs.) For school districts, the Government Claims Act (“GCA”) provides the first and best line of defense against lawsuits and potential liabilities. The GCA provides broad protections against a wide range of possible claims. The catch? These protections are often waived if school districts fail to strictly comply with the GCA’s requirements, in many cases before a lawsuit has even been filed. This presentation will examine the GCA immunities available to school districts and provide an overview of the GCA claim filing procedures necessary to protect our clients against costly litigation and the potential liabilities that can follow. 2023 CCSA Spring Workshop: Braving the New World of Inclusive Athletics: Title IX, Federal Program Monitoring, and other Compliance Issues (1.50 MCLE Hrs.) As we prepare for the release of the new Title IX regulations, the Department of Education has also promised a separate rulemaking to address whether, and how, the Title IX regulations should be amended in the context of sex-separate athletics. As on-the-ground practitioners working in school districts, we see the impact of Title IX regulations and Federal Program Monitoring (FPM) mandates imposed by State and federal government requirements on our schools' athletic programs, staff members, and real student athletes. 2023 CCSA Spring Workshop: Charter School Renewal under Assembly Bill 1505 (1.00 MCLE Hrs.) AB 1505 revised the law regarding the bases to deny a charter school’s initial petition or petition for renewal. One of the most significant statutory changes that relates to the denial of a renewal petition can be found in Education Code Section 47607(e), which permits denial based on "substantial fiscal or governance factors" or if the charter school "is not serving all pupils who wish to attend." This presentation will share recommendations on supporting a charter authorizer that is considering denial of a charter school petition for renewal on these bases.
