SB 200 district residency requirements take effect Jan. 1

On Jan. 1, 2016, changes to the state’s public school residency requirements enacted by Senate Bill 200 (Lara – D, Bell Gardens) will take effect. SB 200 was signed into law Aug. 11, and offers a reprieve for students whose parent or guardian is required to live with their employers. The bill amends current residency laws by stipulating that if a student’s parent or guardian is employed within a school district’s boundaries and lives with the student at the place of employment for a minimum of three days during the school week, that student would then be in compliance with the school district’s residency requirements, even if the parent or guardian’s permanent residence is outside the school district’s boundaries. A separate bill also signed by Gov. Brown on Aug. 11, AB 1101 (Bonilla – D, Concord) clarifies what specific methods can be used when school districts are conducting residency investigations. Both statutes take effect on Jan. 1, 2016.
