On July 15, 2010, the State Board of Education will consider the proposed regulations for the Open Enrollment and Parent Empowerment Acts.
The Open Enrollment Act directs the SBE to create a list of 1,000 "low-achieving schools" and any pupil from one of those schools may apply for enrollment in a higher performing school anywhere in the state. The list was released as part of the SBE agenda yesterday and begins on attachment 3 of the SBE agenda item number 32 titled Open Enrollment Act—Approve the Finding of Emergency and Proposed Emergency Regulations for Additions to the California Code of Regulations, Title 5.
More than 500 school districts and COEs have schools on the list and six schools have an API score of over 800.
Earlier this week, CSBA submitted a letter on behalf of its members, expressing our profound concerns with many of the components of the regulations. CSBA believes the proposed regulations exceed the scope of the statute and is beyond the State Board's legal authority.
